Lithium Battery Shipping Rules Every U.S. Importer Must Know

If you're importing electronics, power tools, e-bikes, vaping devices, or anything else with a rechargeable cell, lithium battery regulations apply to your shipment. Ignore them and you're looking at cargo holds, fines up to $87,117 per violation, and potential criminal liability.

This isn't a niche compliance issue. The U.S. Pipeline and Hazardous Materials Safety Administration (PHMSA) has ramped up enforcement significantly since 2020. CBP now flags lithium battery shipments at a much higher rate than five years ago. Here's what you actually need to know before your next shipment moves.


Why Lithium Batteries Are Regulated So Heavily

Lithium batteries are classified as Class 9 Hazardous Materials under 49 CFR (Title 49 of the Code of Federal Regulations). The reason is thermal runaway — a chain reaction where a damaged or defective cell generates heat faster than it can dissipate it, causing fire or explosion.

There have been over 400 air cargo incidents involving lithium batteries recorded by the FAA since 2006. That number is why the regulations are this strict, and why they keep tightening.

The key regulatory frameworks you need to know:

  • 49 CFR Parts 171–180 — U.S. DOT hazmat transportation rules
  • IATA Dangerous Goods Regulations (DGR) — governs air freight internationally
  • ICAO Technical Instructions — the international treaty standard IATA is based on
  • IMO IMDG Code — governs ocean freight
  • UN 38.3 — the battery testing standard; your supplier must have passed this

If your goods move by air — which most e-commerce imports do — IATA DGR Section 3.9 and Packing Instructions PI 965 through PI 970 are your primary reference documents.


The Two Battery Types That Determine Everything

Before you look at any other rule, you need to know exactly what type of battery you're importing. The entire compliance framework splits on this point.

Lithium-Ion (Li-ion) Batteries

Rechargeable. Found in phones, laptops, power banks, e-bikes, cordless tools. The relevant UN numbers are UN 3480 (batteries alone), UN 3481 (batteries in or with equipment).

Lithium Metal (Primary) Batteries

Non-rechargeable. Found in watches, medical devices, military equipment, some IoT sensors. The relevant UN numbers are UN 3090 (batteries alone), UN 3091 (batteries in or with equipment).

Lithium metal batteries are generally considered higher risk because they contain lithium metal rather than lithium ions in solution.


The Three Watt-Hour Thresholds That Trigger Different Rules

For lithium-ion batteries, watt-hours (Wh) determine which shipping tier applies. Get your supplier to confirm the exact Wh rating — it's usually on the battery label or in the product spec sheet.

Under 100 Wh (per cell: under 20 Wh)

Standard consumer electronics range. Most smartphones (10–16 Wh), laptops (40–99 Wh). These can ship as cargo on passenger aircraft under Section II of IATA PI 965/PI 966, with restrictions on state of charge (max 30% charge for standalone batteries) and packaging requirements.

100–300 Wh (per cell: 20–60 Wh)

E-bike batteries, power stations, larger power tools often fall here. These are Section I shipments under IATA — significantly more restricted. They cannot travel on passenger aircraft as cargo. Cargo aircraft only. They require shipper's declaration for dangerous goods and full hazmat documentation.

Over 300 Wh

Large format industrial batteries. These are subject to special arrangements and are effectively off-limits for standard air freight. If you're importing these, you're moving by ocean, and you still need full IMDG compliance.

For lithium metal batteries, the threshold is measured in grams of lithium content: under 1g per cell / 2g per battery for Section II, 1–5g per cell / 2–10g per battery for Section I.


Packaging Requirements You Cannot Skip

IATA PI 965 through PI 970 aren't suggestions. These are the exact requirements your freight forwarder and airline will check.

Key requirements for standalone lithium batteries (UN 3480 / UN 3090) shipped by air:

  • Strong outer packaging — UN-certified fiberboard or equivalent
  • Inner packaging — batteries must be individually packed or separated to prevent short circuits; terminals must be protected
  • State of charge (SoC) — cells and batteries must be at or below 30% of rated capacity for Section II standalone batteries
  • Gross weight limits — Section II standalone Li-ion: max 5 kg net per package
  • Markings — packages must display the lithium battery mark (the flame/battery graphic), UN number, and net weight
  • Labels — Class 9 hazmat label required for Section I shipments

One thing importers get wrong constantly: the 30% SoC rule. Your factory ships batteries fully charged by default. You need a contractual requirement in your purchase order that batteries are discharged to ≤30% before packaging. Put it in writing. Customs and carriers have rejected full containers over this.


Documentation: What Must Travel With the Shipment

For Section II (smaller, lower-risk) shipments by air, the minimum documentation includes:

  • Commercial invoice — must describe the batteries accurately, including UN number, Wh rating, and quantity
  • Packing list — confirming packaging configuration
  • MSDS / SDS (Safety Data Sheet) — for the battery chemistry
  • UN 38.3 Test Summary — proof the batteries passed the required safety tests; CBP and airlines can request this at any time

For Section I shipments, you additionally need:

  • Shipper's Declaration for Dangerous Goods — completed by a certified DG shipper
  • Emergency Response Information (24-hour contact)
  • Carrier acceptance documentation

The UN 38.3 test summary is worth a specific call-out. Under 49 CFR 173.185(e), effective January 1, 2020, shippers must be able to provide a UN 38.3 test summary upon request. This means your Chinese supplier needs to have gone through certified third-party testing — not just claim compliance. If they can't provide a test summary from a recognized lab (SGS, Bureau Veritas, TÜV, Intertek), that's a red flag.


CBP and the HTS Classification Angle

On the customs side, the way you classify your battery-containing goods affects your duty rate and scrutiny level. Most lithium batteries fall under HTSUS Chapter 85, specifically:

  • 8507.60 — Lithium-ion accumulators (batteries)
  • 8507.80 — Other batteries and accumulators

Products that contain batteries (like smartphones or laptops) are classified by the finished article, but CBP examiners will still check the battery compliance documentation on flagged shipments.

Under Section 301 tariffs, batteries from China imported under 8507.60 currently carry a 25% additional duty on top of the base rate of 3.4%. For e-bike batteries, the base rate under 8507.60 is 3.4%, but add Section 301 and you're at 28.4% total. That's material for your landed cost model.

If you're importing battery-powered devices, make sure your supplier's commercial invoice doesn't just say "electronics" — the invoice description needs to match the HTS code, include the battery spec, and be specific enough that CBP can verify it matches what's in the box.


Ocean Freight: The IMDG Rules

If your batteries are too large for air or you're moving bulk inventory by sea, the IMDG Code (International Maritime Dangerous Goods) applies.

Key ocean-specific requirements:

  • Lithium batteries are classified under IMDG Class 9, UN 3480 or 3090
  • Special Provision 188 covers small batteries moving in limited quantities — this is the primary relief provision for consumer goods
  • Containers carrying lithium batteries must be stowed away from heat sources and must be documented on the Dangerous Goods Manifest
  • Some carriers require Cargo Transport Unit (CTU) packing certificates

Ocean is generally more permissive than air for lithium batteries because thermal runaway in a sealed container at sea is more manageable than in an aircraft. But "more permissive" doesn't mean unregulated. PHMSA has issued penalties to ocean shippers who misdeclare battery shipments.


Five Mistakes That Get Importers Into Trouble

1. Letting the factory handle compliance without verification. Your Chinese supplier says "we handle DG all the time." That doesn't protect you legally. You, as the U.S. importer of record, share liability.

2. Not checking state of charge. Factories charge batteries for QC testing and don't discharge them. Require written confirmation and audit periodically.

3. Using a freight forwarder that isn't DG-certified. IATA requires DG training for anyone preparing dangerous goods shipments. Ask your forwarder for their DG certification credentials.

4. Assuming small = exempt. Small batteries still require the lithium battery mark, proper inner packaging, and UN 38.3 documentation. Section II has requirements — it's just less paperwork than Section I.

5. Misclassifying on the commercial invoice. "Power bank" on an invoice for a 150 Wh portable power station will get flagged. Be specific: include the Wh rating, UN number, and battery type on every commercial invoice.


What to Do Before Your Next Shipment Moves

Run through this checklist before you book freight on any battery-containing shipment:

  1. Confirm battery chemistry (Li-ion vs. lithium metal) and exact Wh or gram rating
  2. Obtain UN 38.3 test summary from your supplier
  3. Verify state of charge ≤30% is specified in your PO (standalone batteries by air)
  4. Confirm your freight forwarder holds current IATA DG certification
  5. Ensure commercial invoice includes UN number, Wh rating, battery type, and quantity
  6. Verify packaging meets IATA PI 965–970 for air or IMDG SP 188 for ocean
  7. Confirm your HTS classification and calculate duty exposure including Section 301

This isn't a one-time exercise. IATA updates its DGR annually. The 2024 edition included updated guidance on Section I quantity limits. If you're not reviewing your compliance setup each year, you're probably operating on outdated assumptions.


Lithium battery compliance is one of the highest-stakes areas in import logistics for e-commerce. The rules are complex, the enforcement is real, and the consequences of getting it wrong — cargo holds, fines, and customer delays — are expensive.
